Please read these Terms and Conditions ("Agreement", "Terms and Conditions") carefully before using www.elevatedanceworkshop.com ("the Site") operated by Elevate Dance LLC ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.elevatedanceworkshop.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.
INTELLECTUAL PROPERTY
The Site and its original content, features and functionality are owned by Elevate Dance LLC and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
USE OF THE SITE AND SERVICE
To access or use the Site, you must be 18 years of age or older and/or their parents and/or legal guardians to have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using the Site without their parents and/or legal guardians consent. Elevate Dance LLC makes no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. Elevate Dance LLC disclaims all liability for any inaccuracy, error, or incompleteness in the Content.
You agree to use the Site and to purchase services or products through the Site for legitimate, non-commercial purposes only. You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.
Your use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Elevate Dance LLC, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet your requirements.
ORDER CONFIRMATION
We will email you to confirm the placement of your order and with details concerning product delivery. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible. For store related inquiries or for general concerns please reach out to ourteam@elevatedanceworkshop.com.
Paying the workshop deposit opens up registration for your requested workshop dates. Studio registration must be completed no later than 30-days before the workshop start date. All registered workshop attendees must have a parent/guardian present to sign the workshop waiver at registration check-in.
An Elevate Dance choreographer will grant 6-hours to teach a choreographed piece. Any additional rehearsal time needed will need to be set up separately and additional fees may apply. The customer is responsible for any additional fees, including but not limited to, studio rental space.
Video packages are available for limited time. Contact us for the specific time on any purchased video package.
CANCELLATIONS, REFUNDS & RETURNS OUR POLICY IS SIMPLE AND STRAIGHTFORWARD. THERE ARE NO CANCELLED ORDERS. NO REFUNDS. NO EXCHANGES. NO RETURNS. ALL SALES ARE FINAL.
Elevate Dance LLC or any Elevate Dance representative is not responsible for any lost, stolen, or damaged property.
All Elevate Dance LLC material is copyright protected.
In purchasing digital products, the customer agrees to refrain from burning, sharing, copying, and/or printing of any kind from the Elevate Dance LLC Library.
PRODUCT DESCRIPTION
We endeavor to describe and display the Service as accurately as possible. While we try to be as clear as possible in explaining the Service, please do not accept that the Site is entirely accurate, current, or error-free. From time to time we may correct errors in pricing and descriptions. We reserve the right to refuse or cancel any order with an incorrect price listing.
In any Elevate Dance event or event Elevate Dance personnel are in attendance, permission is given for images and videos through video, photo and digital camera, to be used solely for the purposes of Elevate Dance LLC promotional material and publications, and all outside personnel waive any rights of compensation or ownership.
MEDIA RELEASE
Any attendee agrees to give permission for images and videos captured during an Elevate event through video, photo, and digital camera, to be used solely for the purposes of Elevate Dance LLC promotional material and publications, and waive any rights of compensation or ownership thereto.
REFUSAL OF SERVICE
The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
LIMITATION OF LIABILITY
In no event shall Elevate Dance LLC nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from your use of the Site, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney's fees, arising from your violation of any third-party's rights.
GOVERNING LAW
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Georgia, United States, without giving effect to any principles of conflicts of law.
CHANGES TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
